Judge Dismisses Lakewood BOE Lawsuit for Not Providing $30 million in State Aid

A Judge has Dismissed  lawsuit brought by the Lakewood BOE against the dept of education. The state last year initially was to give Lakewood $30 million in funds but than it was  stripped out of the budget. The BOE passed the budget assuming it was getting the funding.
The Lakewood Shopper reports that the judge ruled Lakewood BOE does not have standing to assert the various claims in the complaint.

R' Aaron Lang  a lakewood lawyer and teacher  wh initialy sued the state to change  the funding formula for Lakewood ads:

The district’s case in federal court was dismissed for the essentially the same reasons its case was dismissed last July in NJ administrative Court. Besides for being moot due to the loan,
the court reasoned that it would have had to interject into the political process and the sovereignty of the legislature. See EDU 08386-2019.
As for standing issue in the federal filing, the state tried to dismiss Alcantara in 2015 saying that district has standing, not my students. This was convenient for the state to argue since the BOE did not want to join me. NJ law has been clear since the 1980s that students have standing, not a BOE.
What perplexes me is the federal filing. San Antonio v Rodriguez 411 US 1 (1973) says that education is not a fundamental right. The Supreme Court also said that disparities in funding based on wealth and geography do not violate equal protection. The NJ funding law does not discriminate against a protected class (San Antonio ISP's students also were mostly members of a protected class) So the discrimination argument does not seem to have merit. The SFRA is rational under the federal constitution because its disparately affects everyone in Lakewood, not just those of a protected class. (Many people would like to see San Antonio reversed, but Lakewood will not be the test case).

The only cause of action is under the T & E clause of the NJ constitution, not federal.



Both BOE lawsuits are similar to the suit filed as Brick, Toms River, et. al. v NJ DOE, EDU 2207-17 which was dismissed last year, also because those BOE did not have standing.

Why do towns waste so much of their taxpayer money with expensive lawyers?

Physician: In the past 2-3 weeks the Lakewood Kehilla has seen several new cases of COVID-19 illness, now about 20 cases. Most, but not all, have been connected to infected individuals coming to Lakewood from Florida. In addition, it is reported that the Deal, NJ community now has some 40 new cases of illness since last week. These cases are connected to infected individuals who have come to Deal from Brooklyn.

-Murphy: Death count not from today: Sadly, we must report an additional confirmed 20 COVID19 deaths. As we’ve been regularly noting of late, most of these deaths occurred some time ago, and are only today being added to the confirmed count. Of the deaths we’re reporting today, 7 occurred within the past 5 days.
-Murphy: I’m creating a  Compliance Task Force – headed by  NJ Comptroller  Kevin Walsh – to:

Sources told Kosher Today that the sale was finalized on June 30th and that the company was undergoing major changes including a potential move of its warehouse from Brooklyn to a location in New Jersey.

Today is the Yartzeit of Harav Elyashiv Zatzal
Rav Shlomo Elyashiv was one of the greatest Kabbalists in recent Jewish history. Settling in the town of Shavl, he proceeded to author his magnum opus the Leshem Shevo Veachlama, and influencing young Rabbis like Rav Kook in kabbalistic teachings.
In 1924, he moved to Eretz Yisroel together with his daughter and son in law Rav Avraham Levinson who changed his name to Elyashiv at this time. They were accompanied by their Bar Mitzvah age son, the future Rav Yosef Shalom Elyashiv.

Upon arriving in Jerusalem, they became an influential family, with Rav Avraham Elyashiv founding the Tiferes Bachurim organization, which provided a framework for Torah study for the young working men of the Old Yishuv.

-Yated Lakewood team on Twitter: New at BMG: Aside for a 236-spot parking lot that was approved by Lakewood's Planning Board last week, BMG also has plans to pave the existing lot adjacent to the Bendheim "Yoshon" Bais Medrash, resulting in two, fully-paved lots servicing the 7th Street/Private Way buildings.

-Last night Lakewood Zoning board approves 23 homes at the corner of Neiman road and Cross street currently its a r40 zone and only 8 homes are allowed but after the masterplan  the zoning was changed to R12 allowing 23. The board conditioned the permits on the county widening Cross street which has begun. Some members objected that they just approved Eagle ridge which will have 5000 cars coming to Cross street andit will be congestion city. Other members  said that the other option is another  school will be built there and he rather have ratables than a school. Lawyers said that the lots may not all be 12,000 some will be 13 or 14.

KAJ discontinues Hashgach on Empire poultry. Currently Empire is under the kosher supervision of the OU and Tartikov Hashgocho under Rabbi Yechiel Babad.

KAJ Statement:
 After many years of giving the highest levels of kashrus supervision at Empire kosher Poultry we will be removing our Hashgocho effective  July 20, 2020. This decision was made after much discussion and  deliberation both with Empire and internally. Unfortunately, circumstances have developed that prevent us from being able to guarantee that our standards of  kashrus will continue to be met. Products manufactured through July 20, and bearing the seal of the KAJ are  still under our supervision.  see full statement below
