BMG Press Release on Court Ruling

At 9:59 this morning, the N.J. American Civil Liberties Union (ACLU) had in hand an Appellate Division court ruling from 2016 that the State of New Jersey Building our Future Capital Improvement grants awarded five years ago to Princeton Theological Seminary and Beth Medrash Govoha were unconstitutional, and that N.J. law prohibited such grants.  As of 10:01 today, neither of those held true.
This morning, the N.J. Supreme Court ruled that theN.J. Constitution does not categorically prohibit grants to sectarian institutions such as BMG and PTS.

Two years ago, the Appellate Division ruled that the State Constitution barred State grants to BMG and PTS.  The Appellate Division reasoned that the N.J. Supreme Court’s 1978 decision in Resnick v. East Brunswick Township Board of Education did not allow for such State funding.

Today the N.J. Supreme Court disagreed with the Appellate Division, and vacated the Appellate Division ruling.  The Court found that “Resnick’s broad summary language about religious organizations should not be misconstrued,” and that “the issue decided in Resnick is not the same as the question presently before us.”

The Supreme Court concluded that Resnick does not prohibit the awards made by the State to institutions such as BMG and PTS, and vacated the decision of the Appellate Division that had banned the grants to BMG and PTS.  The Court remanded the case back to the Secretary of Education for a clarification of the factual record.

We are ever grateful to Mr. Avi Schick, who has served as tireless pro bono counsel on this matter for us.

While we still have a final hurdle to clear before we see this funding, today’s decision is a central and critical one in favor of religious equality, significantly advancing the rights of sectarian institutions in New Jersey.

BD"E Petirah of Harav Nochum Eisenstein ZT"L Rav of Forest Park shul in Lakewood. Formerly from Boston and Talmid of Bais Medrash Govoha.
Levaya, tomorrow morning 10:00am at the Forest Park Bais Medrash, Tiferes Yosef on Forest park circle kevurah will be in Lakewood.
Matzav Rav Eisenstein was a noted talmid chochom and marbitz Torah, whose leadership and ahavas haTorah inspired many people during his lifetime.

A devoted talmid of Rav Nosson Wachtfogel zt”l, mashgiach of Beth Medrash Govoha, Rav Eisenstein released the shmuessen of Rav Nosson in the popular Leket Reshimos.

Rav Eisenstein was a boki in many areas of Torah, and had a grasp of yedios in some of the lesser-studied areas, such as zemiros Shabbos, on which he released a sefer that is acclaimed for its insights.

For many years, Rav Eisenstein’s divrei Torah in English were published as a column in the American Yated Ne’eman.

For the last half decade, Rav Eisenstein battled illness. His passing today has plunged his mispallelim in Forest Park and the great Torah community into mourning.

The Cleveland Jewish community and the Torah world at large are shocked broken hearted and saddened by Sudden Petirah of Mr. Mendy Klein Z"L of Cleveland a noted Philanthropist, Bal Tzedaka Tomech and Machzik Torah of Yeshivos Torah institutions and mosdos all over the world. He suddenly collapsed earlier today at a Lag Baomer event in the young Israel of Cleveland he was in is upper 60’s. He was to be honored in a few weeks by the Agudah Dinner. The sad news sent shock waves at the Torah Umesorah convention taking place tonight.  Levaya will be held 12:00 p.m. Friday at the Yavneh School in Cleveland  2475 S. Green Road in Beachwood.
Kevurah will be in Eretz Yisrael.

Agudas Yisrael issued the following statement:
Reb Mendy was one of the parnesei hador, a baal tzedaka on a grand scale whose chesed toward the downtrodden and needy was
legendary. What set Mendy apart from other generous philanthropists was his passion -- his passion for Klal Yisroel and Eretz Yisroel, his passion for the downtrodden and the needy, his passion for fairness and justice. He invested his tzedaka dollars wisely, and the dividends on those investments are reflected most dramatically in the countless tortured neshamos to whom he brought healing and happiness.
Agudath Israel was looking forward to paying public tribute to this extraordinary individual at its upcoming annual dinner. Instead we will search for ways to perpetuate his remarkable legacy for generations to come.
We join Mr. Klein's choshuve family in mourning this terrible loss.

BDE: Rabbi Shaul Shatzkes ZT"L

Matzav.com It is with great sadness that Matzav.com reports the passing of Rabbi Shaul Shatzkes zt”l. He was 62 years old. Rabbi Shatzkes was a respected talmid chochom and marbitz Torah who resided in Lakewood, NJ. He suffered a stroke a few months ago.
A descendant of the famed Rav Moshe Shatzkes zt”l, the Lomza Rov, Rabbi Shatzkes was a son of Rav Aaron and Judith (Korb) Shatzkes. Rav Aaron was a talmid chochom who served as a maggid shiur at Yeshivas Rabbeinu Yitzchok Elchonon in New York City.

Rabbi Shatzkes was a talented writer and disseminator of Torah, working, among other things, for ArtScroll/Mesorah on its Schottenstein Talmud. His Torah columns appeared in Yated Ne’eman and elsewhere. Rabbi Shatzkes spent his years immersed in Torah, as evidenced by his wide range of knowledge in Gemara, halacha and other limudim. He carried himself with humility and simplicity, which belied his greatness as an oveid Hashem and a talmid chochom of note. He was the consummate oveid Hashem, and his passing leaves a deep void in the hearts of all who knew him.

Rabbi Shatzkes resided on East 8th Street in Lakewood, where he was a beloved mispallel of Rabbi Hertzberg’s shul. He is survived by his wife, Mrs. Mashy Shatzkes, and their nine children. Rabbi Shatzkes also leaves behind a brother, Rabbi Yechiel Shatzkes of London.

The levayah will be held tomorrow at the Congregation Sons of Israel’s Holocaust Memorial Chapel, located at 613 Ramsey Street, off of East 7th Street, in Lakewood, NJ. Exact times are still being finalized.

Incitement, Only when its from someone Else

Yeshiva world news posted a article translated from Israeli Website BHOL with this headline "SHOCKING HATE: Calls For Hitler YM’S To Kill Chareidim And Vicious Incitement Allowed By Major Israeli News Agency" The article is about disgusting comments online directed against frum Jews in EY celebrating Lag Baomer the article quotes:
"the responses to the article – which were approved for publication – went beyond all limits. From calls to murder the chareidim celebrating in Meron, to calls on Hitler YM”S to return to work, to requests for missiles from Iran and Hezbollah to strike the celebrants and terrible curses against the Rebbe and the celebrants.

Lets take a look at some of the Comments posted on YWN platforms (see snapshot below) with its constant reporting and bashing against anything done by the Peleg faction, or any practice of frum charedi Jews that the Editors at Yeshiva world don't agree with and they proudly call a Chillul Hashem. The depicting of frum Yidden in a bad light advertised to the world. The charedi bashing that goes on in the comments and even in the posts makes one think they are reading YNET or other hateful sites. The double standard and hypocracy is quite noticeable.
On a youtube post April 15, in a recent hafgana where police used brutal force against protesters these comments went up on the post.  "Shoot them with real bullets""These people don't deserve to live""Shoa them they are no better than neo nazis"  It appears the comments have since been removed but they were up there for a while. see below.
