An interesting article, about An ancient, anonymous song for Shabbos Chanukah, Ichlu Mashmanim, appears in siddurim and is chanted in some communities. The whole composition sings the praises of food, meals, meat dishes, wine and miscellaneous culinary delights to be consumed on that Shabbos and the line ending each stanza goes: “A beis kur sell or lease; rent a beis kur for Shabbos Chanukah!” In his Responsa (137), Mahari of Bruna, a pupil of the Terumas HaDeshen, remarks that no Torah scholar could have written the song as a Chanukah meal is not defined as a se’udas mitzvah.

Others even stress (sefer shaar yissochor) that only foolhardy people or a laitz could have composed it, as evident from its contents (Orchos Chayim, 670:8). On the other hand, some rebbes, such as Rebbe Pinchas of Koritz zt”l, sang it on Shabbos Chanukah and a few scholars attribute it to Rabbi Avraham Ibn Ezra as the initial letters of its lines form Avraham. Those favoring the song were somehow able to lend its contents a spiritual connotation and some surmise that beis kur is used as a pun: In Old French a yard for raising and fattening poultry was called a bas court (“low courtyard” – the final s was then, as in certain dialects today, pronounced). The message, then, is “Sell your beis kur” – your field – and rent a bas court for Shabbos Chanukah. Others explain the reference to Bais hayayin is talking about the Bais hamikdosh.

-The last day of Chanukah known as Zos chanukah there are special tefillos to recite and segulos for parnasah on זאת חנוכה. The sefer נטעי גבריאל brings down a מנהג ספרדים to recite 308 times the פסוק of  "שובו שברו לנו מעט אוכל"  as a Segulah for Parnasah on Zos Chanukah the word שוב is Begematria 308.

-A old minhag in Yerushalayim to daven for rain-

The Lakewood Shopper newspaper reports - On Tuesday December 11, 2018 the planning board will hold a hearing for a major site plan for a piece of land on a 15 acre property at the corner of Massachusetts avenue and Cross street. Previous attempts to receive variances for duplexes  were denied since  its a R20 residentiak cluster zone and duplexes are not allowed.

The new plan is under the name of a yeshiva and asks for approval of 3-4 story buildings under Lakewood's "campus ordinance". This ordnance basically allows a school to bypass zoning laws if the building is done for the students or faculty of the school according to the report.
Numerous schools in Lakewood have built faculty housing or student housing over the past few years under the campus ordnance.
According to the application one of the buildings will contain 264 dormitory rooms and a 6 unit townhouse building. The yeshiva currently does not have a dormitory according to the report in the shopper

Free Speech or Defamation

$

How far does free speech go, a lawsuit was recently filed as a civil action complaint against several individuals who have also been outspoken about the dealings and going on in the Lakewood township government. The suit  claims about falsely accusing a vendor in conspiring with local government officials to obtain business.

The umbrella term "defamation" includes both libel and slander. Defamation is a statement that may harm someone's reputation. If it is written down, it's called "libel" whereas if it's spoken, it's called "slander."

Defamation law attempts to balance the freedom of speech and open exchange of ideas without giving someone permission to run around spreading lies about another that may harm his or her reputation, ability to earn a living, etc. Note that the expression of an opinion can never be actionable as defamation; statements must be presented as fact to be considered defamation.

Although defamation laws vary by state, generally a plaintiff must show that the statement was unprivileged and published (either spoken to someone else or printed), false, and injurious (harmful in some way to the plaintiff, usually to the reputation, but also may be mental anguish depending on jurisdiction).

Public officials and figures have less protection under defamation laws, though, which means that in order for them to prove a defamation claim, they must also show that the speaker acted with "actual malice."

For example, spreading false rumors that someone has a sexually transmitted disease could be considered defamation, although the defamation would be much harder to prove if that person was a celebrity because it would have to be shown that the speaker was acting maliciously. This is why there are so few celebrity lawsuits against tabloids.

Hamodia: Harav Nosson Herzka zt"l

Hamodia- The olam haTorah of Lakewood, N.J., was thrown into mourning with the passing of Harav Nosson Baruch Herzka, zt”l, one of the most respected Rabbanim of the community. Rav Herzka served as the prominent Rav of Bais Medrash of Pine River and Rosh Kollel, Bais Medrash L’Torah, a night kollel where many exceptional talmidei chachamim learn in the evenings. Rav Herzka took ill several weeks ago and was niftar Shabbos morning at age 67, while surrounded by his family.

Rav Herzka was born in Lakewood, N.J. to his parents, Reb Yaakov Yitzchok (Ernest) and Esther (nee Feldman). In his younger years, he merited seeing Harav Aharon Kotler, zt”l, Rosh Yeshivah of Beth Medrash Govoha. At a young age, due to a health issue, he travelled to Switzerland where he learned in the Lucerne Yeshiva of Harav Yitzchok Dov Koppleman, zt”l, and developed a close relationship with Harav Shimon Zelasnik, zt”l. During this period, which lasted over three years, he rarely spoke with his parents at home due to the high cost of international calls.

Upon his return to the United States, he learned under Harav Binyomin Paler, zt”l, in Yeshiva Mkor Chaim, and under Harav Shneur Kotler in Beth Medrash Govoha of Lakewood. From there, he went to Eretz Yisrael, where he became a close talmid of Harav Berl Soloveichik, zt”l, in Brisk.

In 1977, he married his chasheve Rebbitzen, Mrs. Shani nee’ Sorotzkin, the daughter of Harav Baruch Sorotzkin, zt”l, Rosh Yeshivah of Telshe in Cleveland. Mrs. Herzka is the renowned Menaheles of Bais Yaakov D’Rav Meir in Brooklyn, where thousands of Bnos Yisrael receive their superb chinuch under her direction. During the two months of her husband’s illness, her colleagues and students participated in many nightly conference calls and undertook many kabbalos for Rav Herzka’s merit.

After spending many years learning in kollel, he eventually became a Maggid Shiur in Yeshiva RJJ of Edison, and then joined Harav Gimpel Avigdor Weiss, zt”l, in opening the Yeshiva of Pelham Parkway in the Bronx. When Rav Weiss passed away a mere two years later, the yeshivah disbanded, and Rav Herzka returned to Lakewood.

Approximately 15 years ago, Rav Herzka was appointed as the Rav of Bais Medrash of Pine River, a position in which he served with distinction until his petirah. Besides leading the kehillah with his greatness in Torah, he was known as a leader who took personal responsibility for the lives of his mispallelilm, and many sought out his wisdom and intelligence, asking for his guidance and advice in their daily lives. He dispensed his sagacious counsel to everyone who needed it, and he was known to take the plight of others as if it were his own.

Although the levayah took place on Chanukah, since it was for a chacham b’fanav, hespeidim were given by Harav Yitzchok Sorotzkin, shlita, Harav Malkiel Kotler, shlita, Harav Eli Meir Sorotzkin, shlita, Harav Yaakov Busel, shlita, Harav Yisroel Goldblatt, shlita, and his brothers Harav Yissochor Herzka and Reb Raphael Herzka. In addition, his two sons, Rav Chaim Zalman and Rav Rephael, and his son-in-law Rav Nosson Levine, Rav of Somerset Walk in Lakewood, delivered hespeidim.
